NEW DELHI: The Delhi Supreme Court has taken the position of the central government on a plea on the alleged cybersecurity breaches and data leaks on the online platforms of BigBasket, Domino’s, MobiKwik and Air India.
Judge Rekha Palli gave time to the Centre’s legal counsel and listed the petition from Yarlagadda Kiran Chandra, general secretary of the Free Software Movement of India, which claims to be a national coalition of various regional and sectoral free software movements , for hearing on 9/23.

In his petition, Chandra asked for an instruction to the India Computer Emergency Respondent Team (CERT-In) to comply with his request and to initiate an investigation and investigate the alleged data protection breaches.
The petitioner has stated that he has written to CERT-In several times for violating the data of millions of users of the Big Basket, Mobikwik, Domino’s and Air India platforms has to investigate and keep citizens informed, but no action has been taken.
He said that CERT-In is required under Section 70B of the Information Technology Act of 2000 for the collection and analysis of cyber incident information and apprehension of contingency measures to deal with cybersecurity incidents etc.
The petition states that currently as there is no data protection law in India there and the injured users have no legal recourse against such violations, an investigation by the CERT-In on common data breaches on a mass scale is important to the privacy of users.
