A fast food operator in Brisbane has just registered the name « In-N-Out Aussie Burgers », sparking a potential trademark dispute with the American owner of the famous chain.
A company called Rich Asians Pty Ltd, run by Indian national Puneet Ahori, already has several outlets across town selling seafood, donuts, wings and fried chicken.
The California-based In-N-Out Burger group is known to be thin-skinned when it comes to protecting the sanctity of their well-known brand.
The company, which has previously won numerous counterfeiting litigation, ran some very successful pop-up stores across Australia early last year, but has yet to establish a brick and mortar presence.
Brisbane trademark attorney Nicole Murdoch told us this week that In-N-Out can protect its intellectual property here, even though it hasn’t opened traditional stores yet.
« I assume that anyone trying to profit from the In-N-Out name can see lawyers before they see customers because the American chain protects their brand Down Under, » said Murdoch, who is not responsible for either party acts.
