Lawyers for a South Australian MP accused of assaulting another politician at a parliamentary Christmas party are seeking documents from the investigator who investigated the case for the Speaker of the House

Former liberal, now independent MP Sam Duluk appeared for the first time today in Adelaide Magistrates’ Court on charges of one count of basic assault

He is accused of slapping SA Best MLC Connie Bonaros from the back and making inappropriate comments to members of staff at the event in Parliament

MP for Waite faces a maximum sentence of two years in prison and will return to court in December

Marie Shaw QC, on behalf of M Duluk, told magistrate Alfio Grasso that she wanted to request documents from Paul Hocking of Quark & Associates, who conducted an independent investigation into Mr. Duluk at the 2019 Christmas party

« We simply ask Your Honor to grant permission to issue and serve the summons to the contact manager of Quark & Associates »

In January, then Liberal MP and President Vincent Tarzia released a statement saying he had appointed an independent investigator with « considerable experience » in confidential investigations into complaints filed in the public sector

The following month, Prime Minister Steven Marshall banned Mr. Duluk from the liberal party hall, calling his position « untenable »

Following the alleged assault, Mr. Duluk apologized on Twitter, saying he was « deeply sorry for any act which caused any offense »

M Duluk stepped down as chairman of the Parliament’s Economic and Financial Committee and said he would seek professional help with his alcohol consumption
