On 6. In October 2001, around 1:30 a.m., Whitacre had been drinking in some bars when he decided to drive to Dalessio’s house with a 12-gauge pistol-grip shotgun. When he got there, he broke in and started looking for victims all over the house.
When Theresa heard a noise, she got out of bed and went into the hallway where Whitacre was shooting at the 32-year-old mother with a shotgun.
Douglas, her husband, woke up to hear the gunshots and dialed 911 while she hid under her bed.
The scariest aspect of this crime happened next when Whitacre walked into the bedroom of the couple’s 5-year-old son, Dylan and shot him in the arm with his shotgun. Douglas then heard Whitacre shout, « Does anyone else want some of this? »
Dylan was recovering from his injuries; A doctor would later testify that he was about 15 minutes away from bleeding to death when he was found. Tragically, Theresa succumbed to her injuries.
Whitacre was put in the frame for the murder after three volunteer firefighters said they saw his pickup truck drive home towards Dalessio just before 1:30 a.m. and then saw the same truck from the house drive away the shootings.
Further evidence against Whitacre came in the form of two shotgun shells found at the scene that corresponded to his shotgun.
Whitacre’s motive was that he believed Douglas Dalessio had sold him a house with a faulty sewer system. He had filed a lawsuit against Dalessio that only ended without a resolution two days before the murder.
During his trial, Whitacre’s defense team pointed to the lack of fingerprints or other more tangible evidence that could place him on the scene. They even tried to shift the focus of guilt to Douglas.
However, in January 2003, a jury joined the prosecution and Whitacre was found guilty of first degree murder, attempted murder, aggravated assault and burglary. He was sentenced to life imprisonment, which included an additional 24 to 50 years in prison.
